Overview of the Desktop Licence

To avoid being overly verbose we have kept our Desktop Licence End User Licence Agreement (EULA) simple to cater for the majority of offline uses. If your situation is not addressed please get in touch before you make a purchase at info@thetypefoundry.com

This licence agreement covers typefaces sold with a desktop licence. It does not cover use online, in a game or embedded in an application.

Definitions

Typeface: Shall mean a collection of glyphs that may include a number of weights or styles.
Character Set: Shall mean the common components of a typeface made up of individual glyphs.
Glyphs: Shall mean the individual characters, numbers, shapes and punctuation marks.
We: Shall mean Cure Studio, The Type Foundry on behalf of the creator of each typeface.
You: Shall mean the purchaser of a licence sold per typeface.

Permitted use

1. The typefaces are licenced for use on 1 (one) CPU in an editable format and 1 (one) CPU for output. In plain English that means you can download a typeface and use it on one machine and send that typeface with artwork documents to a printer. You are responsible for making sure the data is secure and that unlicensed copies do not leave your possession.

1.1 For the avoidance of doubt, if you would like to licence a typeface for use on more than 1 (one) CPU, on a website, within a flash presentation, using @font-face, within a font server attached to a network or any other situation where the font data will be read by more than 1 (one) CPU then purchase the appropriate number and type of licence(s). 1.2 To use a typeface on a website you will need to register an account with us and set up a kit to manage the typefaces you would like to use online. The kits are provided with a domain licence that covers use online. Not all our typefaces are available for use online.

Glyphs

2. You accept the number of glyphs within the typeface may not include a full character set. On the www.thetypefoundry.com website there is a glyph page which will show the full set of characters available for a typeface. By purchasing a typeface you accept and acknowledge that you have checked this glyph page.

Copyright

3. You agree to credit where necessary the named creator of the typeface as shown on www.thetypefoundry.com as the creator of the typeface and will not attempt or present a typeface as your own work.

3.1 You understand that the copyright and intellectual property rights of the work shall and always will remain with the original named creator of the typeface as stated on www.thetypefoundry.com

3.2 Any concerns over the copyright, trademark or legal standing of any of the typefaces will need to be sent directly to the owner of the intellectual property of the typeface, that will in the majority of cases be the type creator credited on www.thetypefoundry.com

3.3. We are not liable for any copyright, trademark or legal issues that arise from the use of any of these typefaces. We sell and showcase them in good faith that the creators of the typeface own the work they are selling.

Warranty

4. We make no warranties express or implied on the fitness for a particular purpose of a typeface. We are not liable for any direct, indirect, consequential or incidental damages including damages from loss of business profits, business interruption or loss of business information arising out of the use or inability to use a typeface.

Governing body

5. This Agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales. The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this Agreement or its subject matter or formation (including non-contractual disputes or claims).

Domain

Overview of the domain licence

With the advent and popularity of both mobile apps and new technologies for font use on the web, the structure of font licensing is changing very quickly. To avoid being overly verbose we have kept our licence agreement simple to cater for the majority of uses. However this licence does not cover embedded use in Flash applications, games, IOS applications or any derivative of these technologies that rely on you hosting or embedding the WOFF, SVG, EOT and / or TTF files.

This licence agreement covers typefaces used within the Kit service provided, hosted and administered by The Type Foundry.

We: Shall mean Cure Studio, The Type Foundry on behalf of the creator of each typeface
You: Shall mean the purchaser of a licence sold per typeface.
Kit: Shall mean the online hosting service provided, hosted and administered by Cure Studio, The Type Foundry that generate the Cascading Style Sheet rules (CSS) and Javascript (js) you will include on your own webpage HTML.

Kits overview

1. Kits are a subscription service provided, hosted and administered by Cure Studio, The Type Foundry.

Kits detail

2 Typefaces available for use online can be added to a Kit.

2.1 You can create unlimited kits, and add unlimited typefaces and domains to kits.

2.2 Your subscription level is measured by page requests made via your kits to our servers.

2.3 Each typeface within a kit makes a separate request to our server on a web page loading. This means if you add 1 (one) typeface to a kit, each page viewed on your site will make 1 (one) request to our server. If you have 10 (ten) typefaces in one kit, each page viewed will make 10 (ten) requests to our server.

2.4 As we add more typefaces to The Type Foundry that are available for use online, you will be able to use and add them to both existing and new kits.

2.5 If we have to remove a typeface for any reason from The Type Foundry, we will continue to host the typefaces until such point they are either redundant or You have been given fair notice that We are unable to host the typeface which will be at least 30 (thirty) days.

2.6 If we make modifications, improvements or updates to the typefaces then they will be included within the source file of the kits, and therefore you will benefit from any updates as they are made.

Our servers

3 We have invested in our technical set up to make sure our servers fulfil the number of requests being made. We have a system in place that allow us to scale up our hosting when the server demands it.

3.1 Currently our servers are both based in the UK, although we have tested the service from locations in Asia, Europe and America and found their to be negligible latency.

3.2 As the service base grows we will be adding a server cluster with distributed bases across various locations to better serve files with minimal latency.

3.3 As this is a new service we are unable to give uptime guarantees based on past service use. We will be reviewing this every 3 months to ensure our service is being delivered as efficiently as possible.

Usage

4. For each kit you can determine a usage amount. This helps you manage multiple kits and the percentage of your quota you would like to dedicate to particular domains.

4.1 We will alert you when you are at 75% of your overall subscription level per month to give you time to review your kit settings.

Payment

5. Your payment will be taken monthly, and will cover the following months activity.

5.1 You can increase your subscription at any time, which will increase your subscription level immediately.

5.2 You can reduce your subscription level at any time, which will decrease your subscription level immediately.

5.3 You can cancel your subscription at any time, which will take effect immediately.

5.4 Your subscription quota will reset each month.

5.5 Your subscription will be taken automatically each month until you take action to change it.

Service Level Agreement

6. By subscribing you acknowledge there is no service level agreement in place between Cure Studio, The Type Foundry or the original named creator of the typeface as stated on www.thetypefoundry.com and you.

6.1 However, if for any reason we are unable to provide our service we will alert all account holder immediately about what has happened and how we are resolving it.

By purchasing a typeface you accept and acknowledge that you have checked this glyph page and acknowledge what glyphs are available per typeface.
